All of our seeds are fresh for the current season and are all germination tested with results well above the required percentage.
Growing seeds is a natural process with many inherent, intangible risks beyond the control of Azure Dandelion.
Therefore, we can not guarantee individual results.
There are too many variables in gardening that can affect germination, including, but not limited to: weather, soil, insects, methods, etc., so therefore we do not offer refunds, replacements, or returns.
We know gardening takes a lot of time and effort, if you are new to gardening, or don't know what you are doing, there are a lot of good books out there that can help you achieve success, so your local library is a good place to start.
County extension offices are a good source of tips for your specific area.
We will not be responsible for crop failures.
Purchase constitutes buyers acceptance of 100% of the risk involved in growing Azure Dandelion seed.
All refund claims for consideration must be sent to us by registered mail. Any claim that the seeds are defective must be submitted within 10 days after the defect of the seeds becomes apparent. All claims must be submitted within 30 days of invoice date. All claims shall be submitted with original Azure Dandelion packaging. Claims will be examined, based on germination retest of seed lot sample a replacement or refund will be given, at our discretion.
Legal terms:
Waiver and complete release agreement including limitation of warranty and limitation of liability.
Seller, herein referred to as "Azure Dandelion"
Growing seeds is a natural process with many inherent, intangible risks beyond the control of Azure Dandelion.
Azure Dandelion and the purchaser of these seeds acknowledge that this sale of seeds is a commercial transaction.
Therefore, as a condition of sale of all seeds sold by Azure Dandelion, the purchaser acknowledges that he or she has been informed of the risks associated with growing seeds, and hereby waives any right to assert any claim against Azure Dandelion, whether for breach of contract, tort, negligence, or otherwise.
The purchaser also releases Azure Dandelion from any and all claims relating to all seed supplied by Azure Dandelion.
Furthermore, the purchaser expressly acknowledges there is no remedy against Azure Dandelion for any loss resulting from the use of the seed in this purchase.
Additionally, if any seed is repackaged by purchaser, there are no remedies against Azure Dandelion and Azure Dandelion will have no liability whatsoever to any other parties.
It is further agreed by the purchaser that Azure Dandelion offers no warranties, express or implied, including the warranty of merchantability or fitness for a particular purpose, regarding the seed, and all warranties are specifically herein disclaimed.
Azure Dandelion shall not be liable for incidental or consequential damages or crop failure damages as a result of the use of this seed.
The purchaser also agrees to defend, indemnify and hold harmless Azure Dandelion against any and all claims, actions, proceedings, or other potential liabilities against Azure Dandelion of any nature whatsoever relating to any resale or transfer of said seed.
Warranty:
In no event shall we be responsible for any crop loss or failure.
We also warrant that all seed sold has been labeled as required by law, and that at time of delivery, they conform to the label description.
Purchaser agrees that by completing this transaction and paying for their order to Azure Dandelion that they have read the above notice, understand it, accept it and agree to be bound by all of its terms.
Purchaser also acknowledges that they have had the opportunity to consult with an attorney regarding this notice.
